Florida has a new Racing Law, Florida Statute § 316.191. Previously a "Withhold" of Adjudication on the racing charge prevented a driver's license suspension by DMV. Under the new law, a withhold is the same as a conviction and if convicted of racing, a driver will face a mandatory (1) year driver's license revocation. A second conviction for racing results in a two-year driver's license revocation.
Florida Law also prohibits "speeding" as a lesser included offense to racing.
So
what does this mean?
Racing is a First Degree Misdemeanor, a serious charge, and you must be able to fight the charges and win or, get the State to amend the charge and/or agree on good cause to some other resolution that would result in dismissal of the charges in order to preserve your Florida driver's license.
